A United States federal judge, Beryl A. Howell, has openly reprimanded the Federal Bureau of Investigation (FBI) and the Drug Enforcement Administration (DEA) over what she described as an unjustifiable delay in releasing documents linked to Nigerian President Bola Ahmed Tinubu.

The judge’s criticism followed a Freedom of Information Act (FOIA) request filed in 2022 by American transparency activist Aaron Greenspan, who has continued to push for the release of records allegedly connected to Tinubu’s past activities in the United States.

The request, which has attracted growing attention both in Nigeria and internationally, was reportedly supported by investigative journalist David Hundeyin, whose involvement has helped keep the matter in the public spotlight amid renewed scrutiny of Tinubu’s historical U.S. records.

According to court filings, Justice Howell expressed frustration at what she viewed as deliberate foot-dragging by the FBI and DEA, warning that the agencies appeared to be undermining FOIA provisions that require timely disclosure of public records. She reportedly questioned why both agencies have been unable—or unwilling—to provide a clear timeline for when the requested documents would be made available, despite mounting legal pressure and sustained public interest.

Sources familiar with the proceedings said the judge’s concerns were heightened by the agencies’ failure to demonstrate transparency in their handling of the request, raising suspicions that the review process was being unnecessarily prolonged.

The records being sought are believed to relate to earlier U.S. investigations reportedly associated with Tinubu—an issue that has remained controversial for decades and continues to generate political tension in Nigeria, particularly since his emergence as president.

Analysts say the case has now grown beyond a simple document request, evolving into a major test of accountability, international transparency, and how far U.S. law enforcement agencies can be compelled to release sensitive information involving a foreign leader occupying one of Africa’s most powerful political offices.
Observers also point to recent global events as a reason the matter is being treated with heightened seriousness. They argue that the United States has historically taken aggressive action when drug-related allegations are tied to national security or international stability—citing how former President Donald Trump once escalated pressure and military posturing against Venezuela under the pretext of narcotics trafficking concerns.

In Tinubu’s case, however, the continued secrecy surrounding the requested records has only intensified speculation, with many Nigerians questioning what exactly U.S. authorities may be withholding—and whether America’s silence signals deeper political calculations.

With Justice Howell’s latest intervention, there are growing expectations that the FBI and DEA may now be forced to accelerate their internal review, potentially leading to the release of documents that could either clear Tinubu’s name or deepen long-standing allegations surrounding his past.

Meanwhile, Greenspan has insisted that his FOIA request is strictly rooted in public interest and accountability, arguing that transparency is essential for democratic credibility—especially when unresolved questions continue to trail the background of a sitting head of state.

The case remains ongoing, with Nigerians and international observers watching closely as U.S. agencies face increasing judicial pressure to comply with the FOIA request without further delay, in a matter that could carry significant political implications for Nigeria and its relationship with the United States.
